Employers who have not applied for short-time working payment until June 30, 2020 will be able to apply until December 31, 2020 and benefit from short-time working payment as of December 1, 2020 pursuant to the Presidential Decree numbered 3238 dated November 30, 2020 (“Decree No. 3238”).

Workplaces that will apply for short-time working payments for the first time as of December 1, 2020 may benefit from short-time working payment for up to three months and the payment will not be paid for the first week from the start of the short-time working period. Short time working payments made under the Decree No. 3238, are not deducted from the initial unemployment allowance period.

Accordingly, the President is authorized to alter the short time working payments application period entirely or sectorial basis until June 30, 2021.

Background

As a response to Covid-19 outbreak, provisional article 23 was added to the Unemployment Insurance Law numbered 4447 (“Law No. 4447”) adjusting the conditions of short-time working payments. As per provisional article 23 of the Law No. 4447, the employees working under an employment contract for the last 60 days prior the commencement of the short-time working are deemed eligible to receive the short-time working payment until June 30, 2020, granted that they have paid unemployment insurance premium for at least 450 days in the last three years upon their application regarding Covid-19. In addition, employees who were not deemed eligible pursuant to the relevant premium payment criterion had been granted the right to benefit from the short-time working fund for the period remaining from their last unemployment benefit entitlement, limited to the short-time working period.
